23 April 2012: Notice that Mr. Stuart C. E. Mackellar has replaced Mr. Richard E. Fogerty as Joint Liquidator of the Fund in BVI has been uploaded to the Creditor and Investor Information page. This notice has also been provided to creditors and investors of record by email.
On 8 May 2009, William R. Tacon and Richard E. L. Fogerty of Zolfo Cooper were appointed as Joint Provisional Liquidators ("JPLs") of Kingate Euro Fund Limited (the "Fund") by an Order of the Eastern Caribbean Supreme Court High Court of Justice British Virgin Islands ("BVI Court").
Click here for a copy of the order  The order was made by the BVI Court pursuant to an ordinary apllication by the Fund, pending the hearing of the Fund's Originating Application for the appointment of Messrs. Tacon and Fogerty as Joint Liquidators on 4 June 2009.
On 4 June 2009, the BVI Court duly appointed the JPLs as Joint Liquidators of the Fund.

On 6 March 2012, the BVI Court made an Order replacing Mr. Fogerty with Stuart C. E. Mackellar as Joint Liquidator of the Fund on the basis that Mr. Fogerty was resigning as Joint Liquidator of the Fund.
